1. Agreement to Terms

By accessing or using HytaleHome ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

You represent that you are over the age of 18, or have parental consent if under 18. Your access to and use of the Service is also subject to our Privacy Policy and Cookies Policy.

2. Definitions

  • Company (referred to as "we", "us", or "our") refers to HytaleHome.
  • Service refers to the HytaleHome website and subdomain services.
  • You means the individual or entity accessing or using the Service.
  • Account means a unique account created for you to access our Service.
  • Subscription refers to the paid services offered on a recurring basis.

3. Description of Service

HytaleHome provides custom subdomain services for Hytale game servers. Our Service allows you to:

  • Register a custom subdomain (e.g., yourname.hytalehome.com)
  • Point your subdomain to an IP address or hostname you control
  • Update your DNS target at any time through our dashboard

4. Account Requirements

To use our Service, you must:

  • Be at least 18 years old, or have parental consent
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access

5. Acceptable Use

You agree NOT to use our Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Distribute malware, spam, or malicious content
  • Host or promote illegal activities
  • Impersonate others or misrepresent your affiliation
  • Attempt to gain unauthorized access to our systems
  • Use subdomains for phishing or fraudulent purposes

We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. Subdomain Rules

When selecting a subdomain, you agree that:

  • Subdomains are assigned on a first-come, first-served basis
  • We may reject or revoke subdomains that are offensive, misleading, or infringe trademarks
  • Subdomains cannot be transferred or sold to third parties
  • We reserve certain subdomains (e.g., "admin", "api", "www")

7. Payment and Billing

  • Subscriptions are billed monthly in advance
  • All payments are processed securely through Stripe
  • Prices are in USD and do not include applicable taxes
  • You authorize recurring charges until you cancel
  • Failed payments may result in service suspension

8. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through the "Manage Billing" option in your dashboard, which opens your Stripe billing portal.

  • Cancellations take effect at the end of your current billing period
  • You will retain access until the end of your paid period
  • After cancellation, your subdomain may become available to others

Refunds

We offer refunds within 7 days of your initial purchase if you are unsatisfied with the service.

  • To request a refund, email support@hytalehome.com with your account email and reason
  • Refunds are processed within 5-10 business days back to your original payment method
  • Refunds are not available for accounts terminated due to Terms violations
  • After the 7-day period, no refunds will be issued for unused subscription time

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for downtime, DNS propagation delays, or issues with third-party services (Cloudflare, your hosting provider, etc.). We may perform maintenance with reasonable notice when possible.

10. Limitation of Liability

Notwithstanding any damages that you might incur, our entire liability under any provision of these Terms and your exclusive remedy shall be limited to the amount actually paid by you through the Service in the 12 months preceding the claim, or $100 USD if you haven't purchased anything.

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, business interruption, or loss of privacy) arising out of or in any way related to the use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions, each party's liability will be limited to the greatest extent permitted by law.

11. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limitation to the foregoing, we provide no warranty or undertaking that the Service will meet your requirements, achieve any intended results, be compatible with any other software or systems, operate without interruption, meet any performance or reliability standards, or be error-free.

Some jurisdictions do not allow the exclusion of certain types of warranties, so some or all of the above exclusions may not apply to you. In such cases, the exclusions shall be applied to the greatest extent enforceable under applicable law.

12. Intellectual Property

"HytaleHome" and our logo are our trademarks. "Hytale" and the Hytale logo are trademarks of Hypixel Studios. We are not affiliated with, endorsed by, or sponsored by Hypixel Studios. You retain ownership of any content you host on your own servers.

13. Governing Law

The laws of the State of California, United States, excluding its conflicts of law rules, shall govern these Terms and your use of the Service. Your use of the Service may also be subject to other local, state, national, or international laws.

14. Disputes Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at support@hytalehome.com.

15. For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

16. United States Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.

17. Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
